What is the Legality Rating?
Legality rating is a type of ethical rating intended for Italian companies, introduced in 2012. It was created for the purpose of promoting ethical principles in business behavior in Italy, implementing the law converting Decree Law March 24, 2012, no. 29. The Antitrust Authority (AGCM), in collaboration with the Ministries of Justice and the Interior, issued in November 2012 the Regulations defining the assignment of legality rating to companies operating in the national territory with a turnover exceeding 2 million euros.
The importance of the Legality Rating
The legality rating is not only a symbol of ethical excellence, but also has relevant practical implications. In fact, it is considered in the provision of public financing and access to bank credit. Banks, in particular, are required to justify any credit refusals to rated enterprises through a note to the Bank of Italy. This system aims to incentivize companies to maintain legal and transparent behavior while improving their reputation and trustworthiness.
The Requirements for Getting the Rating
A ⭐️: The Basic Level
To obtain the basic rating of one star, certain self-certified minimum requirements must be met:
- Absence of personal or property prevention measures.
- Absence of personal or property precautionary measures for directors and partners.
- Absence of condemnation orders by the Authority and the European Commission for antitrust offenses.
- Absence of measures for non-compliance with occupational health and safety laws.
- Absence of wage, contribution, insurance and tax violations.
Up to Three ⭐️⭐️⭐️: Excellence
To achieve the maximum score of three stars, six additional requirements are needed, including:
- Possession of an effective control body under the governance and prevention system required by Leg. 231 of 2001.
- Presence of acclaimed corporate social responsibility (CSR) systems.
- Adherence to industry codes of ethics.
